TERMS & CONDITIONS

By accepting these Terms and Conditions, you are entering into a binding contract with A Moment In Time Productions. DVD Greeting Cards is a subsidiary of A Moment In Time Productions. A Moment In Time Productions and DVD Greeting Cards will be known hereafter as AMITP. By making a purchase with AMITP, you agree to be contractually bound by the policies contained herein.

Services and Products
AMITP is a production company who creates professional movies and greeting cards from client’s home video footage, photographs, and other documents. Light editing of photographs may be included in the base price, including red-eye reduction, cropping, and light/dark contrast corrections, however we do not guarantee this will enable all pictures to be included. We do not guarantee every tape will be fit for transferring or that every picture will be included due to its poor quality, or any other reason. Poor quality video footage or photos may not be included in the video. We use high quality DVD-R media for all DVD projects. This media is compatible with 94% of DVD players on the market. Some DVD players, especially older players do not play this type of media. You are responsible for determining the compatibility of your DVD  player. You will always be able to order a VHS copy of your movie or to view in online for a certain period of time.

Limit of Liability
While the greatest care and respect is taken in handling all client’s materials, some tapes and photographs are of poor quality and do not withstand the editing process. There may also be unknown technical errors that damage or destroy tapes and/or other materials. In the unlikely event that the damage and/or destruction of videotape, printed pictures and/or documents occur, AMITP’s liability shall be limited to a full refund. Furthermore, AMITP makes no warranties, expressed or implied, and we are not liable for returning material that is not labeled with your name and address. AMITP is not liable for loss or damages of original videotape, photographs, and documents including but not limited to transit in the mail.

Payment
A deposit is due at the time an order is placed to reserve your spot on our project calendar. Work will begin after the transfer of funds has taken place. Clients have three days to cancel their order and receive a full refund, not including shipping charges. The remainder of your balance, including shipping charges shall be due before your movie is shipped. If checks are returned or payment is not made in 30 days, a $25 late fee will be assessed and 5% interest will begin accruing each week thereafter. If you are ordering a DVD Greeting Card, full payment is due at the time of order. If a personal check is returned for any reason, an insufficient funds fee of $50 will be charged and work on the client’s project will cease until full payment has been received. We will not redeposit your check without your directive to do so. Further, it is your responsibility to understand the costs associated with the production of your movie.

Copyright
By agreeing to these terms, you declare that all materials you want included in your movie is not a violation of copyright law. If you are specifying a particular song, you agree that you purchased the music and are able to include the music under your Fair Use rights. If you are using video footage taken by a professional videographer who retains the rights to the video, you must get written permission for us to use the footage in your movie. Likewise, if you want to use a photograph taken by a professional photographer who retains rights, you must get written permission for us to use the image. By submitting materials you are declaring your legal rights to use the materials, and will be able to provide written approval of the materials by the copyright owner.

All material contained in AMITP’s website, brochures, business cards, promotional DVD’s and any other materials are copyrighted and owned by AMITP. Copying of any DVD’s AMITP provides to you is a violation of United States copyright law. We will retain a copy of your video and you are able to purchase an additional copy at the current rate. We retain ownership of the movie and retain the rights to use the movie and images for promotional purposes, including but not limited to AMITP’s website.

All material included on the website is copyrighted and owned by AMITP and nothing in part or in whole may be copied without the expressed, written permission of AMITP.

Submission of Materials
The client will submit materials in an organized fashion. Everything is labeled with your name and address. All materials must be numbered in the order they are to be used. This includes each videotape labeled chronologically or in the order in which you want them to appear, and all pictures and documents must also be numbered. If submitting digital images, the files names should be in alpha-numeric order. We do not guarantee the order of your materials, but all care will be taken to follow all your instructions. If materials are out of order, we will charge a fee to organize them. All original material sent to AMITP shall be returned to the client.

Return policy
If AMITP failed to meet written specifications that were provided to us during or before you shipped materials including, but not limited to the inclusion of important scenes, music, the spelling of names, etc. we will redo the video free of charge. You have the opportunity to preview your movie (and greeting card) on the internet and give your approval before we finalize your project. If you would like further corrections or changes, you will incur a fee. Once the project has shipped or been turned over the the client, all sales are final and there are no refunds.
